GENERAL CONDITIONS OF USE ECOJOLIE

Article 1: Purpose and scope

 

The present Terms and Conditions of Use (T&Cs) provide a legal framework for the use of the services of the Ecojolie website (hereinafter referred to as "the Site").

Access to the Site constitutes a contract between Ecojolie and the Internet user, and must be preceded by acceptance of these Terms and Conditions. Access to this platform implies acceptance of these Terms and Conditions. If the User does not accept them, he/she must not use this Site.

 

The following terms are referred to hereafter as long as they are written with the first letter capitalized:

 

  • "Site": the https://www.ecojolie-store.com site and all its pages.

  • "Seller": Ecojolie, a natural person, offering its products or services on the Site.

  • "Customer Account": the personal account created by the customer and accessible on the Site.

  • "Internet user" or "User": Any person using the Site or any of the services offered on it.

  • "Pattern": Product in the form of a dimensioned, reduced-size diagram sold in PDF format by Ecojolie.

 

Ecojolie reserves the right, at any time, to change, modify (update date indicated at the top), supplement or delete portions of these terms and conditions of use. It is the Internet user's responsibility to check for any changes. The general conditions of use applicable to the Internet user are those in force on the day he/she browses the Site.

 

Article 2: Access to the Site

 

The Ecojolie website provides free access to the following services:

  • Sale of sewing patterns in the form of a dimensioned reduced-size diagram sold in PDF format.

  • Sale of marketing licenses.

  • Sale of electronic gift cards.

The Site is accessible free of charge from anywhere by any User with Internet access. All costs incurred in accessing the services (hardware, Internet connection, etc.) are the responsibility of the User. Access to member services is by means of a login and password. For maintenance or other reasons, access to the Site may be interrupted or suspended by the publisher without notice or justification.

Article 4: Intellectual property

 

All text, photographs, trademarks, logos, illustrations, technical documents and drawings (referred to as "Content") are the property of Ecojolie and are protected by trade dress, copyright and other applicable intellectual property and unfair competition laws.

No Content from this site may be reproduced, copied or transmitted in any form or by any means without the prior written permission of Ecojolie.

 

 

Article 5: Liability

 

Although the information published on the site is deemed reliable, the Site reserves the right not to guarantee the reliability of the sources.

The information published on the Ecojolie website is for information purposes only and has no contractual value. Despite regular updates, the Site cannot be held responsible for any changes in administrative or legal provisions that may occur after publication. The same applies to the use and interpretation of information provided on the platform.

The Site declines all responsibility for any viruses that may infect the User's computer equipment after using or accessing this Site.

The Site cannot be held responsible in the event of force majeure or the unforeseeable and insurmountable act of a third party.

The Site cannot guarantee the total security and confidentiality of data. However, the Site undertakes to implement all methods required to do so to the best of its ability.

Article 8: Publication by the User

 

The Ecojolie Site may allow members to post comments.

In their publications, members are required to respect the rules of Netiquette as well as the rules of law in force.

The Site has the right to carry out a priori moderation on publications and may refuse to put them online without having to provide any justification.

The member retains all intellectual property rights. However, any publication on the Site implies the delegation of the non-exclusive and free right to the publishing company to represent, reproduce, modify, adapt, distribute and broadcast the publication anywhere and on any support for the duration of the intellectual property. This may be done directly or through an authorized third party. This applies in particular to the right to use the publication on the web and cell phone networks.

Each time it is used, the publisher undertakes to mention the member's name in the vicinity of the publication.

The User is responsible for any content he/she places online and undertakes not to publish any content likely to harm the interests of third parties. Any legal proceedings brought by an injured third party against the Site shall be borne by the User.

The Site may delete or modify User content at any time, for any reason and without notice.

 

Article 9: Contract duration

 

This contract is valid for an indefinite period. The beginning of the use of the services of the Site marks the application of the contract with respect to the User.

 

Article 10: Applicable law and jurisdiction

 

This contract is governed by French law. Should any dispute between the parties fail to be resolved amicably, recourse shall be had to the competent French courts to settle the dispute.
